Pretty sure it is. It varies by state, but most states require a hood under "required equipment" in their general laws for vehicles.
Of course, even if the hood isn't mentioned specifically, it could be illegal for safety reasons....ie your belt snapping and flying out of the engine bay hitting little children or something like that.
When i was a kid, i was pulled over for it and told to go home and put the hood back on. I only had it on because I had just dropped the engine in and didn't want to put the hood back on if i had to mess around some more.

I drove around a few months ago with no hood and never got in trouble passing state troopers and all but I'm I'm new bedford so maybe they just have better things to do
About a week after painting my red 84 I was on my way to mustangs unlimited to show off the new paint at one of the shows, the cheap "locking" pins failed and the cheap fiberglass hood delaminated and flew off on the pike at 70 mph. The toll guy looked at me like I was crazy. I drove it for about a week before I bought a new cervenis hood. It sucked but its funny now that's fixed.
Yeah, one night I was at a red light with him on the side of me(me in a 92 accord lol) and all I can hear is his blower car sounds crazy and its different then a dime a dozen mustang. Don't mean to hi-jack your thread.
